General provisions
The current General Contractual Terms and Conditions (hereinafter: GCTC) includes the rights and obligations of the Service Provider and Purchaser in the respect of browsing and purchasing in the webshop of the website of www.roastopus.hu/com (hereinafter: Website). The ROASTOPUS Webshop (hereinafter: ROASTOPUS) is operated by Roastopus Ltd. (H-7400 Kaposvár, Orci str. 13/A, 27113071-2-14). Those individuals or economic entities (hereinafter: Purchaser) who make an order through either www.roastopus.hu or www.roastopus.com (including subsites), accept the current contractual terms and conditions.
This current terms and conditions is not registered, it is solely concluded electronically. This current terms and conditions is concluded for an unlimited period in Hungarian language. In case of questions that arise on the operation of the Website, ordering and delivery process the Service Provider gives Purchasers more information on its contact details granted in the GCTC (1. Data of Service Provider).

2. Core provisions
2.1. Once Purchaser enters the Website operated by the Service Provider or makes an order with or without preliminary registration, he acknowledges all the rules included in this current GCTC as obligatory and considers himself to be bound by these provisions.
2.2. The author of all materials, descriptions, graphic elements, newsletters, etc. (hereinafter: Content) is the Service Provider named in paragraph 1. Content is under copyright protection. However, Purchaser is entitled to download, print the current contractual terms and conditions, it is directly ensured for Purchasers on the basis of this current GCTC.
2.3. Service Provider is entitled unilaterally to modify GCTC. The modified GCTC is applied to orders made after its publication on the Website. By using the Website Purchaser automatically accepts all the rules available in this current GCTC and in different places of the Website related to the use of the Website.
2.4. Website uses cookies of which acceptance or rejection the browser of the website has to declare when opening the website. See: Data Processing Policy.
2.5. Obligatory provisions of the relevant legislation of e-commerce related to transactions provided within the frame of this current GCTC are valid for the parties without any specific terms.
3. Range of products
Service Provider sells different types of roasted whole bean coffees (hereinafter: Product).
3.1. All prices of products, including promotional fares, are valid until withdrawal or exhaustion of stocks. In case Purchaser orders a product the price shall continue to apply for him. The prices presented contain VAT required by law/community provisions, but do not include delivery fare. Above a certain amount Service Provider disregards the payment of delivery fare by the Purchaser (see: 6. Delivery information).
The level of VAT in case of inland billing and delivery address: 27%
The level of VAT in case of selling abroad from Hungary is regulated by the Implementing Regulation of 282/2011/EU in accordance with the Directive of 2006/112/EK, and by the law of CXXVII/2017.
During Community sales Service provider uses the Union scheme of One Stop-Shop (OSS).
3.2. Packaging cost is not charged.
3.3. On the Website Service Provider indicates the name of product, description and characteristic in great detail, and may present image/images about the product. In certain cases, image/images visible on the data sheet of the product may serve as an illustration.
3.4. If a promotional price is presented, Service Provider shall inform Purchaser about the conditions for the use of the promotion (specified amount of purchase, duration, etc.)
3.5. If Service Provider incorrectly marks the price of a product in the webshop due to an administration mistake, then orders made for that exact item or items will be deleted.
3.6. Service Provider solely serves end-users.
3.7. Service Provider does not hold stock of packs of 1 kg available in the webshop. In case of order Service Provider hands over the product to the delivery service within not more than 8 working days.
3.8. Service Provider grants a promotion for Purchaser on the first day of every week within the campaign called ‘Roastopus Monday’. The promotion is exclusively valid for orders made on the given Monday from 0.00-24.00. Service Provider publishes the details of the promotion on its Facebook site (https://www.facebook.com/roastopus/) and on the website of www.roastopus.com. In case of promotional purchase, regarding purchase limit that ensures free delivery the discounted price is relevant. The discounted price set within the frame of ‘Roastopus Monday’ is also valid for selling abroad.
3.9. Service Provider may grant discount for Purchaser within the frame of a temporary cooperation. These promotions are valid only in case of homeland purchase.
4. Purchasing process
Purchaser can browse and order on the website both with and without registration, furthermore Purchaser has the opportunity to order a selected product from Service Provider via e-mail or even phone.
4.1. Order from the website with registration
4.1.1 Registration and profile
Once Purchaser intends to register, he can do it by clicking on the button ‘Registration’. After clicking on the button ‘Registration’ one can see a filling form in which the following data must be provided for Service Provider:
● Name
● Phone number
● E-mail
● Password
● Password again
● Delivery and invoice data (name, address)
● VAT number (optional)
During registration Purchaser can require a newsletter with the help of choosing the legend used for this purpose. At the bottom of the registration form one can fix his website registration with the data provided by clicking on the button ‘Registration’. At the same time Purchaser must accept the content of Service Provider’s data processing policy regarding online registration, together with the terms and conditions of purchase (the current GCTC). During registration Purchaser can require a newsletter with the help of choosing the legend used for this purpose. After this Service Provider immediately sends Purchaser an automatic confirmation e-mail through which he can activate his account.
4.1.2 Sign in
In case Purchaser has previously registered on the website, by clicking on the button ‘Sign in/Login’ he can enter the website with the help of the e-mail address and password given during registration.
4.1.3 Sign out
If Purchaser intends to sign out, he will be able to do so by clicking on the button ‘Sign out’.
4.1.4 Order
By clicking on the particular product Purchaser can read more information about it in a drop-down text box providing a more detailed description, and where he is able to order the product with the help of ‘Add to basket’ after choosing the appropriate amount. By clicking on the basket sign that can be found in the upper right corner Purchaser can see the information of his order and check the amount and price of the particular products, as well as he can modify the content of the basket. Purchaser can place the order by clicking on the button ‘Cash’. Following this Purchaser can proceed by clicking on the button ‘Next’. There he can fix delivery and payment methods, check and correct billing and delivery data if necessary. After Purchaser has given the data necessary under the title of ‘Summary’ he can find the details of his order where he also has the opportunity to leave a comment to his order placed. Prior to clicking on the button ‘Finalise order’ Purchaser must declare that he has read and accepts the current General Terms and Conditions of Purchase with the help of ticking the text box placed in front of the text ‘I have read and accept the conditions expressed in the General Terms and Conditions of Purchase’. At the same time, he declares that he has got acquainted with the content of the relating data processing policy. By ticking the text boxes Purchaser also understands that after clicking on the button ‘Finalise order’ his order will be sent to Service Provider, about which the system sends a confirmation e-mail. Clicking on the button ‘Finalise order’ Purchaser is under the obligation to pay. Purchaser acknowledges all the conditions and information fixed in his profile and provided during order as obligatory and considers himself to be bound by these provisions by clicking on the button ‘Finalise order’. Regarding the current condition of order Purchaser receives information e-mail(s).
4.1.5 Cancellation of registration
Purchaser is able to cancel his registration through an e-mail sent to info@roastopus.com.
After receiving this message Service Provider deletes registration. By cancelling the registration Purchaser’s data are deleted.
4.2 Order from the website without registration (currently inactive function)
By clicking on the particular product Purchaser can read more information about it on a subpage providing a more detailed description, and where he is able to order the product with the help of ‘Add to basket’. By clicking on the basket sign Purchaser can see the information of his order and check the amount and price of the particular products, as well as he can modify the content of the basket. On the Basket platform, in case Purchaser has any discounts or gift coupons he can make use of the possibility of price reduction by providing the code of these benefits in the field set for this purpose and by clicking on the text ‘OK’. Using the button ‘Back to shopping’ Purchaser can continue browsing among products and can enlarge or modify the content of the Basket. Once Purchaser does not intend to change the content of the Basket, he can finalise his order by clicking on the button ‘Order’. After this Purchaser has to provide the following data in order to fulfil the purchase:
● Family name
● First name
● Phone number
● E-mail
● Delivery and invoice data (name, address)
Following that, Purchaser can add a delivery method preferred (home delivery, Foxpost pick-up point) and fix delivery address. Then Purchaser has to choose a payment method he intends to use. Payment on the webpage is possible via collect on delivery, bank transfer and bank card. Payment method can be chosen by ticking the circle in front of the appropriate method (see in details: Payment conditions). By clicking on the button ‘Continue’ Purchaser can see a summary about his order that contains billing and delivery information, product/products ordered, the financial counter value of purchase and delivery given in gross HUF, and the payment method chosen. Before clicking on the button ‘Purchase’ Purchaser has to declare whether he requires a newsletter or not. He can do it by ticking the text box in front of the text ‘I would like to get informed about the latest products, discounts and events’. By ticking the text box in front of the text ‘I have read and accept the General Terms and Conditions’ he also has to provide a declaration that he has read and accepts the current General Terms and Conditions, and at the same time he declares that he has got acquainted with the content of data processing policy. In addition, by ticking the text boxes Purchaser also takes notice that by clicking the button ‘Purchase’ his order will be sent to Service Provider. By clicking on the button ‘Purchase’ Purchaser is under the obligation to pay. Purchaser acknowledges all the conditions and information provided during order as obligatory and considers himself to be bound by these provisions by clicking on the button ‘Purchase’.
4.3 Purchase without using webpage
Purchaser has to opportunity to order a product via e-mail irrespective of his registration on the webpage. In this case Service Provider sends Purchaser its data processing policy and GCTC in an e-mail. There is no possibility to purchase in person.
4.4 Payment conditions
Service Provider issues an invoice to Purchasers about the order. This invoice can be downloaded any time from the e-mail Purchaser receives from Service Provider. It also can be requested any time from the e-mail address of info@roastopus.com; in such a case Service Provider is obliged to forward the invoice repeatedly within 5 working days.
The currency of payment – depending on delivery address – is HUF (inland), EUR (abroad); payment of the amount on the webpage is possible via collect on delivery, bank transfer and bank card according to the following conditions.
4.4.1 Collect on delivery
In case of home delivery one can pay the amount of products ordered for the courier at the time of delivery in cash or with bank card.
In case of choosing a Foxpost parcel locker one can pay the counter value of the parcel only with bank card at the time of package takeover.
Fee of collect on delivery (inland): 200 HUF in gross.
Fee of collect on delivery (abroad): not available
4.4.2. Bank transfer
If Purchaser chose bank transfer as a payment method during the purchase process, after Purchaser’s order arrives Service Provider sends Purchaser the invoice of the purchase to the e-mail address provided that contains data necessary for bank transfer. As soon as the counter value of the order is credited on the bank account of Service Provider, it hands over the products ordered to the delivery service.
4.4.3. Online payment
The counter value of the order can immediately be paid during the process of purchase via bank card, with VISA, VISA Electron, Master Card and American Express card, as well as using Apple Pay és Google Pay. In case of choosing bank card payment, after clicking on the button ‘Finalise order’ Purchaser is automatically redirected to the payment platform he has chosen (OTP Simple Pay, Stripe) where he can pay the counter value of the package ordered by providing bank card/online bank card/e-wallet data, and about which process Purchaser receives a confirmation e-mail. As soon as the counter value of the order is credited on the bank account of Service Provider, it transmits the product ordered to Purchaser and informs him about the start of delivery.
Data transmission:
When finalizing order – with the help of a ticking box – Purchaser informs Service Provider that he has got acquainted with and acknowledges the content of the privacy policy of Projekt Manufaktúra Ltd. (H-7400 Kaposvár, Orci str. 13/A).
5. Process of subscription to and unsubscription from a newsletter
By browsing the website one can subscribe to an electronic newsletter that is not under any financial obligation. Enquirer can do so by ticking the textbox in front of the text ‘Subscribe to newsletter’ shown in particular spaces of the website, giving his name and e-mail address. Thus Service Provider is entitled to send a newsletter or any other marketing letters to the Purchaser or enquirer once Purchaser previously, expressly and voluntarily contributes to this by giving his data on the website. Enquirer has the opportunity to unsubscribe from the newsletter any time by clicking on the button ‘Unsubscribe from newsletter’ placed at the bottom of the e-mail. Accordingly, Purchaser is able to withdraw his voluntary contribution any time. In such a case Service Provider does not send more newsletters or any other marketing letters to Purchaser after the withdrawal.
6. Delivery information
Shipping area: European Union
Throughout the whole territory of Hungary Foxpost and GLS Hungary (hereinafter: parcel logistics service provider) are responsible for delivering packages ordered as follows:
Foxpost: parcel pick-up point
GLS Hungary: home delivery
Packages ordered abroad - European Union is delivered by FÜRGEFUTÁR.HU or Packeta service provider.
Within 3 working days after ordering products are handed over to the parcel logistics service provider. Service Provider does not provide any guarantee for the parcel logistic company’s fulfilment of delivery within the deadline. Once delivery is not fulfilled within the probable deadline fixed in the GCTC (which is only informative, but not a contractual obligation), Service Provider sends Purchaser a notice. Purchaser has to take account of the fact that the time of delivery may increase before the days of major holidays or public holidays (e.g. Christmas, Easter, etc.). Service Provider does not hold stock of packs of 1 kg available in the webshop, thus in relation with these products Purchaser should expect a longer waiting time. In case of order Service Provider hands over the product(s) of 1 kg to the delivery service within not more than 8 working days.
Products can be ordered with the following delivery options:
6.1. Home delivery by GLS (internal)
Parcels can be taken over from the delivery service provider by the addressee in person, family members resident in the postal address or any authorised person. If Purchaser needs more information regarding delivery or intends to modify his data provided, he has to directly contact the parcel logistics service provider (via phone or online). The parcel logistics service provider attempts to deliver a package twice. Once the employee of the parcel logistics service provider does not manage to hand over the package to the addressee, it will be delivered back to the Service Provider.
Delivery time (first delivery): expectedly within 3 working days after the package is handed over to the parcel logistics service provider.
Delivery fee: HUF 1.990 in gross.
Above the purchase amount of HUF 22.000 in gross delivery is free.
Fee of collect on delivery: HUF 490 in gross.
6.2 Delivery to a Foxpost parcel pick-up point (internal)
In case of preferring a Foxpost pick-up point package is delivered to the parcel pick-up point chosen during the purchase. Purchaser receives an sms once the package can be handed over. It is highly recommended that Purchaser carefully keeps the content of this sms, as he can open the door of the appropriate parcel locker with a unique code sent in the message solely known by him. If Purchaser is not able to hand over the package, in the knowledge of the opening code anyone can pick up the package from the parcel machine. If Purchaser does not hand over the package within a specified number of days defined in the notification, it will be delivered back to the Service Provider.
Delivery time: expectedly within 3 working days after the package is handed over to the parcel logistics service provider.
Delivery fee: HUF 1290 in gross.
Above the purchase amount of HUF 22.000 in gross delivery to a pick-up point is free.
Fee of collect on delivery: HUF 490 in gross.
6.3. Home delivery and parcel pick-up point by Fürgefutár.hu and Packeta (external)
Delivery service provider delivers parcels involving other relating delivery service providers (hereinafter: Current delivery service provider). Parcels can be taken over from the delivery service provider by the addressee in person, family members resident in the postal address or any authorised person. Before delivery a notification will be sent in sms and/or e-mail with the information on delivery time by the current delivery service provider. If Purchaser needs more information regarding delivery or intends to modify his data provided, he has to directly contact the parcel logistics service provider (via phone or online).
Delivery time (first delivery): expectedly within 5-10 working days after the package is handed over to the parcel logistics service provider.
Home delivery fee: EUR 9,9 in gross.
Above the purchase amount of EUR 100,0 in gross delivery is free.

Delivery fee to parcel pick-up point: EUR 7,9 in gross.

6.4 Personal takeover
Product ordered can personally be taken over on the following address in case of paying with bank card or money transfer:

The exact time of takeover must be fixed with the Service Provider in advance.
7. The right of withdrawal from ordering
Within 14 days of taking over a product individual Purchaser (both in case of inland and abroad delivery address) has the right of withdrawal from purchase without any reason, along with sending back the unopened product/products and also with a short statement. In this case Purchaser receives the price of the product reduced with the fee of delivery within 14 days. The template for the short statement can be found in the 1st annex of this current GCTC.
Expenses incurred as a result of returning the product shall be borne by the Purchaser due to the right of withdrawal. Returning is regarded as fulfilled within time if Purchaser sends back the product before deadline. Purchaser loses his right of withdrawal if he opens the package of the product considered as food. Failure or rejection of handing over is not regarded as a rightful withdrawal from ordering.
The right of withdrawal cannot be exercised for companies.
8. Privacy Policy
Personal data of the Purchaser provided during registration, order or subscription to newsletter are stored according to the way set in the relevant law.
Service provider does not transmit customer data to unauthorised persons in any circumstances
At the same time of accepting this current GCTC Purchaser acknowledges the content of the Privacy Policy of the Service Provider.

9. Warranty
Warranty terms related to the product ordered can be found on the package or documentation of the products.
10. Complaints Handling
In case Purchaser has any complaints in connection with the fulfilment of the current contract, he is able to communicate them via e-mail or by post, which contact details are fixed in ‘1. Data of Service Provider’ of the current GCTC. Complaints received via the chat function of social media sites or via mail system are not accepted by the Service Provider.
Service Provider responses the complaint arrived in written format within 30 days after its receipt and acknowledgement. This measure, in pursuance of the current contract, means the date of posting of the reply or, in case of e-mail, the time of sending.
In the event of the rejection of the complaint Service Provider informs Purchaser about the reason of refusal.
If the consumer dispute between Service Provider and Purchaser cannot be settled without involving an external authority, Purchaser has the following opportunities for enforcement:
- Purchaser has the right to initiate a proceeding of the competent conciliation panel of his residence, place of stay or the registered office of the Service Provider.

- The European Commission has established an online platform with the help of which – after registration - Purchasers have the opportunity for settling disputes in connection with online purchase with the completion of an application, avoiding judicial proceedings by this way.
